Frequently asked questions
A securities account is the account through which we receive your orders relating to financial instruments, such as purchases, sales, subscriptions or redemptions.
It is also in the securities account that your financial instruments are recorded, including bonds, units in investment funds, shares and other book-entry securities, i.e. securities represented by electronic records rather than physical certificates.
Opening a securities account requires entering into a financial intermediation agreement, which is legally required to be in written form.
This agreement must include, among other elements, a description of the services to be provided, identification of the financial instruments covered by those services, the rights and obligations of the parties, and information on the available complaints mechanisms.
This information is also available on the website of the Portuguese Securities Market Commission (CMVM), where additional clarification on this financial service may be consulted.
Custody is carried out through a custodian, which acts as a central depository for the securities held by the investor.
For securities to be traded between investors, they must be deposited within the clearing system. The custodian ensures the transmission of all relevant investor-related information, contributing to greater transparency in the asset trading process.
The depositary institution, the custodian agent and the investor.
The Investor Compensation System (ICS) was created to protect investors in cases where a financial intermediary that is a participant in the ICS lacks the financial capacity to repay or return money or financial instruments belonging to its clients.
The ICS guarantees amounts owed to investors by a participating financial intermediary (such as banks, brokerage firms, financial brokerage companies, portfolio management companies or management companies of securities investment funds) that is unable to meet its obligations, covering:
The maximum compensation limit is €25,000 per investor, applicable to the aggregate of the investor’s proportional holdings across all accounts in which they are a holder, regardless of the number of accounts or account holders.
The compensation amount is calculated based on the value of the assets on the date the ICS is triggered. The scheme does not cover any losses resulting from investments in financial instruments.
The Investor Compensation System is intended to protect retail investors. Institutional investors are excluded from protection, namely credit institutions, financial companies, financial institutions, insurance companies, pension fund management companies and entities of the public administrative sector, among others.
An investor may benefit from ICS coverage provided that the following conditions are cumulatively met:
Financial intermediaries are required to safeguard clients’ assets, ensuring that they are duly segregated from the intermediary’s own assets in the relevant accounting and operational records.
If a financial intermediary fails to return securities to the client, those assets are covered by the Investor Compensation Scheme, up to the maximum limit of €25,000 per investor, under the applicable terms.
The ICS does not cover market depreciation, i.e. losses resulting from the normal functioning of capital markets. It also does not cover risks associated with investments in investment funds, nor failures by fund depositary entities to fulfil their obligations.
There are also limitations to ICS protection for certain categories of clients.
